REGULATIONS

FOR THE PROVISION OF ELECTRONIC SERVICES

DEFINITIONS

  1. Registration Form: A form completed by a non-registered user to create an account on the platforms.
  2. Civil Code: Act of April 23, 1964 (Journal of Laws 2017, item 459).
  3. Account: A set of resources and settings created for a user within the platforms, enabling service management.
  4. Unconfirmed Account: A temporary account created upon receipt of a correctly completed registration form or after authentication and acceptance of these Regulations. It may also be created when applying for a job offer without confirming account setup. The unconfirmed account is maintained until account confirmation or anonymization.
  5. Employer(s): An employer or personnel consulting agency publishing job offers or utilizing services provided by Pracomania.com
  6. Candidate Profile: An account feature allowing users to store information such as professional history, education, skills, and documents.
  7. Regulations: These terms and conditions governing the provision of services.
  8. Platforms: Online platforms owned by Pracomania.com
  9. Services: Electronic services provided to registered and non-registered users as outlined in Annex No. 1, which forms an integral part of these Regulations. Users may adjust service settings via their account.

  11. Copyright Law: Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws 2017, item 880).
  12. Electronic Services Act: Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws 2017, item 1219).
  13. Privacy Settings: An account feature enabling users to manage services, modify their scope, and set privacy preferences.
  14. Works: Content as defined by the Copyright Law, published by users on the platforms or within specific services.
  15. User: A natural person with an account using services provided on the platforms.
  16. Non-Registered User: A natural person using services on the platforms that do not require an account.
  17. Recruitment: The process of acquiring and selecting candidates based on job applications and recommending them to employers.
  18. Recruiter: An authorized person conducting recruitment processes on behalf of employers.
  19. Image: A user’s image, name, surname, and honor as defined under Article 23 of the Civil Code.

I. GENERAL PROVISIONS

  1. These Regulations define:
    a. The rights and obligations of the Service Provider, registered users, and non-registered users in relation to service provision.
    b. The rules governing the Service Provider’s liability for service provision.
  2. The Service Provider makes these Regulations available free of charge on the platforms prior to contract conclusion. Provisions not disclosed in this manner are not binding on users.
  3. Services are provided in accordance with these Regulations.
  4. Registered and non-registered users are required to comply with these Regulations.

II. CONTRACT CONCLUSION

  1. A contract with a non-registered user is concluded upon their use of any platform service that does not require an account.
  2. A contract with a registered user is concluded upon correct completion of the registration form and acceptance of these Regulations via the appropriate checkbox.
  3. Completing the registration form requires providing:
    a. A login (email address).
    b. A password.
  4. By submitting the registration form or completing authentication, the user declares that:
    a. The provided information is complete, accurate, and does not infringe third-party rights.
    b. They are of legal age and authorized to enter into the service contract.
  5. Upon receiving a correctly completed registration form, the Service Provider creates an unconfirmed account using the provided email address. An activation email is sent to confirm account creation. The user has 30 days from receiving the activation link to confirm the account. Failure to confirm within this period results in the inability to access the account or related services, and the account will be anonymized. The Service Provider may send reminder notifications during this period.
  6. Users must maintain an active and current email address, monitor it regularly, and promptly update any changes in their account settings.
  7. The email address serves as the primary identification method for communication between the Service Provider and the user.
  8. The Service Provider may refuse account creation, suspend, or delete an existing account if:
    a. The account name is already in use.
    b. Credible information indicates the account name is unlawful, violates good morals, infringes third-party rights, or harms the Service Provider’s legitimate interests.
  9. Users access their account using their login (email address) and password.
  10. Users are responsible for keeping their password confidential and liable for any damages resulting from its disclosure.
  11. The contract is concluded for an indefinite period.
  12. The Service Provider will provide confirmation of contract conclusion on a durable medium within a reasonable time before service provision begins.

III. CONDITIONS FOR SERVICE PROVISION

  1. Technical requirements for using the Service Provider’s IT system include:
    a. Internet connection.
    b. An internet browser supporting HTML documents and accepting cookies.
  2. For mobile services, proper installation of the mobile application or a compatible internet browser is required.
  3. The Service Provider advises users to take appropriate measures to mitigate standard risks associated with internet use.
  4. Services for registered users are provided immediately, while services for non-registered users commence within 24 hours of contract conclusion, or by the end of the first business day following a public holiday.

IV. RIGHTS AND OBLIGATIONS

  1. The Service Provider commits to providing services continuously and without interruption.
  2. The Service Provider reserves the right to:
    a. Temporarily suspend services for maintenance or platform modifications.
    b. Send technical, legal, and transactional notifications as outlined in Annex No. 1.
    c. Refuse service provision if users violate these Regulations.
    d. Modify services, tools, and platform functionalities at its discretion through amendments to these Regulations.
  3. The Service Provider may:
    a. Cease service provision.
    b. Delete user or non-registered user data.
    c. Take other legally permitted actions related to the platforms.
    Users have no claims against the Service Provider in such cases.
  4. Users may manage services, including privacy settings, and modify provided data via their account.
  5. In case of technical disruptions preventing access to services or functionalities, the Service Provider will promptly address the issue.
  6. Users consenting to the public display of their image on the platforms grant the Service Provider, under Article 81 of the Copyright Law, a free, non-exclusive license to store, reproduce, and distribute their image for service execution, user identification, and marketing purposes.
  7. Users declare ownership of copyright to their works and grant the Service Provider a free, non-exclusive, unlimited license for the duration of service provision, covering creation, reproduction, public performance, display, storage, and internet publication.
  8. If a user’s image is included in a work, it will be reproduced and distributed under the exploitation rights specified in point 7.
  9. Users and non-registered users must refrain from:
    a. Providing false or outdated information.
    b. Publishing or transmitting unlawful, offensive, or infringing content.
    c. Using services for commercial advertisements.
    d. Copying, modifying, or distributing platform content, except as legally permitted.
    e. Disrupting platform functionality or causing inconvenience to the Service Provider or other users.
    f. Using services in a manner violating laws, good practices, third-party rights, or the Service Provider’s legitimate interests.
  10. Users must promptly notify the Service Provider of any known violations of these Regulations or unlawful activities on the platforms. The Service Provider will take legally required measures, including restricting access to offending content.
  11. The Service Provider may block access to user resources for violations, including:
    a. Erotic or pornographic content.
    b. Illegal software or related information.
    c. Other unlawful or unethical content, based on credible information.

V. PAYMENT TERMS

  1. Services provided by the Service Provider are free of charge.
  2. Explicit user consent is required for any additional payments, obtained no later than at the time of contract conclusion for such services.

VI. LIABILITY

  1. The Service Provider, registered users, and non-registered users are liable for damages resulting from non-performance or improper fulfillment of obligations under these Regulations, except in cases of force majeure or circumstances beyond their control.
  2. The Service Provider is not liable for damages resulting from blocking access to unlawful data upon official or credible notification.
  3. The Service Provider is not liable for damages caused by service termination or account deletion due to user violations of these Regulations.
  4. The Service Provider is not liable for:
    a. Third-party damages caused by user actions violating these Regulations or applicable law.
    b. Unlawful content published by users.
    c. Information or materials transmitted via the internet by users.
    d. Data loss due to external factors (e.g., hardware failure) or user actions.
    e. Service interruptions due to force majeure or third-party actions.
    f. False, outdated, or incomplete user data.
    g. User non-compliance with these Regulations.

VII. PERSONAL DATA PROTECTION

  1. All users have the right to privacy protection by the Service Provider.
  2. Personal data processing is governed by the Privacy Policy.

VIII. COMPLAINT PROCEDURE

  1. Users may submit complaints regarding service provision.
  2. Complaints are reviewed by the Service Provider.
  3. A valid complaint must include:
    a. User identification (name, surname, email address).
    b. Platform address related to the complaint.
    c. Subject and justification of the complaint.
  4. Incomplete complaints will not be processed.
  5. Complaints must be submitted to:

  6. Complaints are reviewed within 14 days of receipt, with decisions communicated via email to the provided address.
  7. Complaints processed in accordance with these Regulations are not subject to further review.

X. CONTRACT TERMINATION OR WITHDRAWAL

  1. Either party may terminate the service contract.
  2. Registered users may terminate by deleting their account; non-registered users may cease using services.
  3. Registered users may withdraw from the contract within 14 days without providing reasons, by submitting a written statement to:

  4. The Service Provider may terminate the contract immediately, including account deletion, for:
    a. Violation of essential provisions of these Regulations.
    b. False, unlawful, or unethical account names.
    c. Publication of unlawful or harmful content.
    d. Misuse of services.
    e. Deletion of the registered email address.
    f. Repeated notifications of an overfilled email inbox.
  5. Users will be notified of termination within 24 hours, if technically feasible.
  6. The Service Provider may refuse service provision or delete an account if it was previously deleted for violations and recreated.

XI. FINAL PROVISIONS

  1. These Regulations are effective indefinitely. The Service Provider may cease service provision for significant reasons, notifying users via email.
  2. The Service Provider may amend these Regulations for:
    a. Changes in legal regulations.
    b. Compliance with court rulings or administrative decisions.
    c. Security enhancements to prevent unlawful platform use.
    d. Significant functional or technological changes to the platforms.
  3. Users will be notified of amendments at least 14 days in advance via email or platform notification, with changes effective on the specified date.
  4. Users who do not accept amendments may terminate the contract as per Section X.2.
  5. These Regulations and service contracts are governed by Polish law.
  6. Disputes will be resolved by Polish courts.
  7. Users may access alternative dispute resolution through the Office of Competition and Consumer Protection (www.uokik.gov.pl) (www.uokik.gov.pl).
  8. Matters not covered by these Regulations are governed by the Electronic Services Act, Civil Code, and other applicable laws.
  9. Annexes form an integral part of these Regulations.

ANNEX NO. 1: LIST AND DESCRIPTION OF SERVICES

I. Services for Registered Users

  1. JOBS.pl Account
    The account enables storage of education and professional data and access to all available account functionalities. Usage may require:
    a. Completing specific account fields, clearly marked by the Service Provider.
    b. Uploading files in specified formats and sizes.
    c. Providing content compliant with the Service Provider’s specifications. Features include: a. Job Applications
    • Users may apply for jobs by creating or uploading a CV (PDF/Word) or importing one externally, and providing additional details (e.g., email, phone, custom message).A CV preview is available before submission.
    b. Recommended Job Offers
    • Personalized job lists are generated based on user preferences, activity, and applications, sent via email. Users may disable notifications in subscription settings.Recruiters may contact users by phone to present job offers, confirm interest, or verify eligibility, with user consent required for data sharing with employers. Users may opt out via email (mail@pracomania.com) or phone (+48539590623).
    c. Application Status Information
    • Notifications on application status are sent via email, with an option to disable in privacy settings.
    d. Automatic Profile Creation
    • User data may be automatically used to create or update profiles via application features, platform questions, or activated functions.
    e. Saved Job Offers
    • Users may save job listings for easy access, manage them, and add notes. The Service Provider may remove expired offers and send email notifications about saved listings.
    f. Application History
    • Application details (e.g., submission dates, employer evaluations) are automatically stored in the user’s account.
    g. Profile Sharing
    • Users may share their profile with employers, who can search for candidates. Users may disable sharing, but previously shared data may still be processed by employers per their privacy policies. Requests to revoke sharing can be sent to mail@pracomania.com.
    h. Saved Searches
    • Users may receive notifications about new job postings based on keywords or activity, via email, mobile app, or browser notifications. Users may disable saved searches in account settings.
    i. Applying for Job Offers
    • Users with accounts may apply by completing an application form with contact details and documents. Special conditions may include:
      • Applying without registration (creates an unconfirmed account).Optional form completion.Use of external employer systems.Direct email applications.Automatic form population for logged-in users.
    j. Resume Generator (CV Builder)
    • Users may create professional CVs on cv.pl by completing a form. CVs can be saved in the account or downloaded in PDF format.

II. Services for Registered and Non-Registered Users

  1. Recommended Job Offers
    • Available on all platforms.
  2. Resume and Cover Letter Templates, Documents, and Guides
    • Users may download templates and documents. The Service Provider may modify their scope and is not responsible for application outcomes using these materials.
  3. Job Search Function
    • Users may search and filter job postings on the platforms.
  4. Additional Services
    • Services not listed are provided per the Service Provider’s business terms.
